Frequently asked questions
How can a person voluntarily register in the register of persons vulnerable to gambling?
Anyone who believes they have a gambling problem, or whose social situation makes them more susceptible to gambling addiction, may submit a written request for registration to the National Revenue Agency, in person or electronically. The person's own assessment is sufficient.
What are the consequences of registration in the register of persons vulnerable to gambling?
After registration, the National Revenue Agency notifies all licensed gambling operators, who must not allow the registered person to take part in their games. The register is not public, and only authorised officials have access to the data.
What is the deadline for appealing an administrative act?
Administrative acts may be appealed within 14 days of notification (Art. 149 of the Administrative Procedure Code), unless a special law provides for a different period. If the act was first appealed administratively, the period for a court appeal runs from notification of the higher authority's decision or, if it fails to decide, from the last day on which it was required to do so.
Does an appeal suspend the enforcement of an administrative act?
As a rule, yes: an appeal suspends the enforcement of the act. The exception is where the law provides for immediate enforcement or it has been expressly allowed by the administrative authority or the court; in those cases, the order for immediate enforcement is challenged together with the act itself in order to obtain a suspension.
What is the difference between a null and void administrative act and a voidable one?
A null and void act involves such a serious breach of the law that it produces no legal effects at all, and its nullity may be invoked at any time. A voidable act involves a less serious breach: it takes effect and is enforceable until it is annulled by a court or an administrative authority within the prescribed time limits.
